This is the extended information document regarding Cookies provided to Users who connect to and/or navigate on the site www.lestanzedelvetro.org (hereinafter, the ‘Website’), pursuant to Regulation (EU) no. 679/2016 (hereinafter ‘GDPR’), Articles 13 and 122 of the Personal Data Protection Code (Legislative Decree no. 196/03, hereinafter the ‘Code’), the General Provision of 8 May 2014 regarding cookies, and the Guidelines on Cookies of 10 June 2021 of the Personal Data Protection Authority.

1. What are cookies?

1.1. In general cookies are small text files which are transferred from the Website and saved on the User’s terminal (computer, laptop, tablet, smartphone, etc.) through the browser used by each device of the said User; cookies allow the Website to store certain data concerning the use of the site by the User to make them accessible on subsequent access by the said User. Similar to cookies are other types of marker files (active and/or passive) which make it possible to identify the User’s terminal and therefore the use made of it every time the Web is navigated (hereinafter we will use the term ‘cookies’ to include also these types of file which are similar to actual cookies).

Most websites use cookies because they are some of the IT instruments, commonly used on the Internet, which can improve the User’s browsing, also making it possible to offer personalised services (e.g. avoid being asked for one’s access credentials every time, remember the last application used, keep the products in the shopping cart, the content of the pre-filled files, show contents considered important for the User, remember that a message has already been used, etc.). Also search engines, marketing or massive data collection companies and advertisers may (and generally do) use technical cookies and non-technical cookies, including analytics cookies, for example to limit the number of times a particular  announcement is viewed, to establish the duration and/or frequency of viewing of advertising messages (rotation of banners) as well as for so-called. ‘profiling’ (of the behaviour and inclinations) of Users, for marketing, advertising and statistical and commercial analysis purposes in general.

1.2. Various types of Cookies

Based on their origin, cookies can be divided into two categories:

  • proprietary cookies, which are created, modified and deleted directly by the site visited (the Website).
  • third-party cookies, which are created by ‘third parties’, i.e. by other sites or web servers, the owners of their respective contents, for example announcements, images, social media buttons or other services which, on the basis of separate agreements, are viewed by the User in the page of the website that he/she is visiting (the Website).

Based on their duration, on the other hand, cookies may be classified as:

  • temporary cookies (for example session cookies) which are deleted automatically when the browser is closed;
  • permanent cookies which remain available until they are expressly deleted by the User or up to their natural expiry, established by the site that created them.

Based on their function, on the other hand, cookies may be classified as follows:

  • ‘technical’ cookies (with regard to which this information document is sufficient) – those used for the sole purpose of transmitting a communication on an electronic communication network, or to the extent strictly necessary to the provider of a service of the information company explicitly requested by the contractual partner or the User to make such a service available’;
  • ‘non-technical cookies’ (for which the express consent of the User must also be obtained) – those used to trace back to particular identified or identifiable data subjects, specific recurrent actions or behaviour patterns in the use of the functionalities offered, in order to group the various profiles into homogeneous clusters of different sizes so that it will be possible for the Controller, among other things, to adapt the supply of the service in an ever more personalised way, more than what is strictly necessary for the provision of the service, and to send targeted advertising messages, i.e. in line with the preferences shown by the User when browsing.

It should also be made clear that analytics cookies do not per se belong to the category of technical cookies. However, the Personal Data Protection Authority has specified that analytics cookies may be taken together with technical cookies if and to the extent that they are used for the purpose of optimising the Website directly by the Data Controller (or, through it, by the Data Processor) of the site, which may collect information of a statistical kind in aggregate and therefore anonymised form on the number of users and on how they visit the Website. When, however, the carrying out of such statistical analyses is entrusted to third parties, the users’ data must be minimised and anonymised in advance and may not be combined with other processing activities or transmitted to further third parties. In these conditions, the same rules regarding information and consent apply to analytics cookies as do to technical cookies and it will therefore not be necessary to obtain the prior consent of the User for their use.

‘Profiling cookies’ fall within the category of ‘non-technical’ cookies (not necessary for the functioning of the websites) and their use (subject to the prior express consent of the User) is instrumental in the implementation of personalised advertisements, or advertisements based on interests, i.e. advertisements that either the Website or third-party companies (suppliers), in agreement with the Website, may show you based on the recording of your Internet browsing preferences; they are messages selected on the basis of the User’s preferences, collected by the companies using the cookies every time the User connects to the Website, and from there also to other sites connected to the Website, by observing and tracking the navigation (profiling).
The preferences are often detected and established by an automated process (not supervised or controlled by any natural person) principally using the so-called profiling cookies, which may or may not contain Personal Data liable to identify the User, collected by the advertising companies in compliance with the regulations governing privacy.

This recording of the User’s habits (profiling) takes place in accordance with the regulations governing privacy where there is the express consent of the User or where the company can claim a legitimate interest in the tracking of the User (including the legitimate interest of advertising its services or products), unless the latter has objected to this.

In some cases, furthermore, it is possible that, in order to identify interests, these companies may use the answers to online questionnaires or other information that you may have freely supplied online, following acceptance of the privacy statement required by the privacy regulations.

Such profiling (advertising) cookies are not necessarily based on the gathering of Personal Data liable to identify the User, even if advertising and also personalised cookies may imply the gathering of information liable to lead to the identification of the User.

In all cases, it should be noted that it is always necessary to obtain the consent of the User to be permitted to implant cookies other than ‘technical’ cookies in his/her terminal: and therefore also for the purpose of installing profiling cookies, for advertising purposes and/or for personalised advertisements.

Article 22 of the GDPR offers the User the possibility, whether at the first connection to a site, including the Website, and also later (cf. Point 4), to object to profiling operations, including those carried out on the basis of automated decisions, where the User has not given explicit consent and/or where this processing produces legal effects concerning him/her or has a similar significant impact on his/her person or fundamental rights.

The consent may be given by each User once and for all (unless substantial changes are made to the information document and/or the present Cookie Policy, or in the case of not accessing the Website for more than six months), at the beginning of navigation on the Website, by ticking (even en bloc) the desired cookies on the dedicated page which will appear to the User when connecting to any page of the Website. The User has the right to amend his/her options at any time (cf. Point 2.2).

It should be noted that the exercise of the choices offered to the User with regard to the use or otherwise of non-technical cookies, including advertising and profiling cookies, influences only the use of this kind of non-technical cookie, whether of our Website or of those of ‘third parties’, and does not affect the ‘technical cookies’ used to improve navigation and ensure the functioning of specific services, such as, for example, sessions of our applications (e.g. statistical monitoring by Google Analytics, certain functions for sharing on social media etc.). 2. The rights of Users with regard to cookies

2.1. Cookies as a particular kind of ‘personal data’

In accordance with the regulations in force, to the extent that such cookies can identify the User (i.e. the terminal from which the User operates), such as for example non-technical (profiling) cookies, they can be classified as ‘personal data’, the ‘processing’ of which must be authorised (that is, permitted) by each User of the Website on the basis of an ‘information document’ (i.e. the present Cookie Policy, which must be understood as being an integral part of the Privacy Policy regarding the Website), which in turn must be made available to each User before the collection and/or processing of the data, namely at the time of the first navigation on the Website by the User, so that the said User may accord ‘informed consent’ to the processing of such of his/her Personal Data that are relevant to navigation on the Website.

2.2. Consent to the use of ‘non-technical’ cookies

Most browsers installed on the User’s terminal can accept the cookies automatically; however, the User of the Website:

  • has at all times the right to consent to or deny the enabling of ‘non-technical cookies (including the analytics cookies that are not used by the Website as ‘technical’ cookies, in accordance with the exception specified expressly in Article 122 of the Privacy Code);

One should be aware, however, that, with regard to the quality level of the services offered by the Website, the deactivation of the cookies may entail for the User the impossibility of using all or some of the online functionalities and in some cases of accessing the site. This is why, also in this Website, it is possible to deactivate some cookies, but not all: in particular, it is not possible to deactivate ‘technical’ cookies that are strictly necessary for the functioning of the Website (for the interaction between User and Website).

2.3. The Information Document with regard to ‘technical’ and ‘non-technical’ cookies. Reference to Privacy Policy In relation to ‘technical’ cookies the User’s consent is not required, but he/she has a right to an adequate ‘information document’ regarding their nature and use (concerning this, see the following point). The present Cookies Policy therefore includes the information document due to the User, both with regard to technical cookies and the other types of cookie, including profiling and/or advertising cookies. Please note that, in turn, the Cookies Policy is to be considered an integral part of the so-called extended Information Document on the processing of the User’s Personal Data by the Website (so-called Privacy Policy).

3. Which are the cookies of our Website and which those of ‘third parties’?

Like most websites, our Website also uses cookies to improve the user experience, to simplify the use of our applications and to provide advanced functionalities that would not be possible without the use of such cookies, (including, sometimes, User ‘profiling’ functions).

The sessions are indispensable procedures to carry out site access authentication by registered Users, or to use applications that require the insertion of the data in several stages. The sessions are also useful so as not to lose the data entered in the applications where the User changes page or where the applications are combined.

The following are the principal functionalities of our Website which use permanent cookies, of a technical kind:

  • save the User’s preferences in certain applications;
  • establish if a User is visiting the site for the first time and the data of the last visit (this cookie is based on an anonymous identification number from which it is impossible to trace back to the IP address);

The monitoring code [GA] uses cookies that can be described as technical cookies to allow us to analyse, in an anonymous and aggregate form, the traffic of Users on our Website (most visited pages, new users, return users, browser and device types, loading and viewing speeds of pages etc.).

In addition to ‘standard’ information, our Website sends to the platform [GA], always in an anonymous form and without personal data, some specific analysis dimensions that help us to have a better understanding of our users’ behaviour in order to improve the service offered with regard to:

  • Analysis of registered users’ traffic;
  • Enabling of cookies on the basis of the present information document;
  • Use of adblock software (installing and uninstalling).

Please note that this statistical survey of accesses to our Website, as is the case for the user’s interests for advertising purposes, is completely anonymous, simply allowing us to monitor the overall traffic on the pages of our Website in order to detect any problem areas due to malfunctioning or loss of positioning in the principal search engines.

3.3. ‘Third-party cookies’

4. Possibility of deactivating cookies and changing one’s own preferences regarding the use of cookies (granting, revoking and/or changing consent)

4.1. The possibility of deactivating cookies: cookies may be deactivated by using the settings of one’s own browser.

As already mentioned, the deactivation of cookies involves, for technical reasons, the limitation or impossibility of having access to all of the Website functionalities, or the impossibility for advertising companies to show you personalised advertisements which might interest you.

For example, deactivating session cookies from the browser makes it impossible to connect to the site and enter the reserved area, and prevents the functioning of certain entirely session-based applications.
